PUBLIC PATH DIVERSION ORDER (NO.1) 2022
NOTICE is hereby given that The Fife Council, in
exercise of the powers conferred on it by Paragraph 7
of Schedule 16 to the Town and Country Planning
(Scotland) Act 1997 (hereinafter referred to as “the
1997 Act”) and of all other powers enabling it in that
respect, has confirmed without modification the
foregoing Order authorising the diversion of a section
of existing public path on land to the west of Andrew
Melville Hall, North Haugh, St Andrews.
A copy of the confirmed Order and the relevant plan
showing the path to be diverted is available by applying
by email to legal.support@fife.gov.uk or by post to
Legal Services, Fife House, North Street, Glenrothes,
Fife, KY7 5LT.
The Order comes into operation on 11 May 2022 but a
person aggrieved by the Order may in accordance with
the provisions in Section 238 of the 1997 Act, by
application to the Court of Session within 6 weeks from
that date, question its validity on the ground that it is
not within the powers conferred by Part IX of the 1997
Act or that his interest has been substantially prejudiced
by a failure to comply with any requirements of said
Part IX or any regulations made thereunder.
